Terms of Use
Effective date: 1 July 2026
These Terms apply to memberships, bookings and use of the Golf 365 Performance Studio. Please read them carefully before registering, booking or using the facility.
Authorisations
By registering, accepting these Terms and using the Facility or Services, you authorise and agree to each of the following. This section is a summary for your convenience. The operative provisions are set out in the numbered clauses below, which prevail if there is any inconsistency.
- Terms of Use
- You accept these Terms in full, including all clauses and schedules, and any updates made in accordance with clause 19.
- Risk acknowledgment
- You acknowledge and accept the inherent risks of using the Facility and Services described in clause 8, and agree that Golf 365’s liability for those risks is limited as set out in clause 8.
- Personal information
- You consent to Golf 365 collecting, using and disclosing your personal information as set out in clause 15.
- Payment authority
- You authorise Golf 365 to debit your Stored Payment Method for the fees and charges in the Fee Schedule in Schedule 2 as and when they become payable under these Terms, including recurring membership fees (including the annual membership fee charged at the start of each annual term where an annual membership auto-renews), guest fees, late-cancellation and no-show fees, damage and downtime costs (in accordance with clause 9.3), early-cancellation amounts and dishonour fees. This authority continues as set out in clause 11.5.
- Guests and children under 18
- If a Guest who is a Child, or a Complimentary Child, you bring to the Facility is not your own child, you warrant that you have obtained that child’s parent’s or guardian’s consent under clause 6.4, and you indemnify Golf 365 against any liability arising from that child’s participation, as set out in clause 6.5.
1.Definitions
Approved Supervised Program: a structured junior golf program offered by Golf 365 under the direct supervision of Chris Graham.
Booking Platform: the website, application or other online system approved by Golf 365 for memberships, bookings and access permissions.
Child: a person under 18 years of age.
Complimentary Child: a Child who accompanies a Member under the complimentary child benefit in Schedule 1.
Facility: the Golf 365 Performance Studio at Unit 4, 6 Bonanza Drive, Billinudgel, NSW 2483.
Facility Downtime Rate: the rate per unavailable simulator bay per hour in the Fee Schedule in Schedule 2.
Facility Rules: the rules in Schedule 3, as updated from time to time in accordance with clause 19.
Fee Schedule: the fees and charges in Schedule 2, as updated from time to time in accordance with clause 19.
Force Majeure Event: anything beyond Golf 365’s reasonable control, including natural disaster, pandemic, government action, power failure, internet outage or another event of a similar kind.
Golf 365: Golf 365 Performance Studio Pty Ltd ABN 75 695 021 866.
Guest: a person who enters or uses the Facility at the invitation of, or while accompanying, a Member, other than a Complimentary Child.
Member: a person who has registered with Golf 365 under a membership category in Schedule 1, and has accepted these Terms.
Membership Schedule: the membership categories, fees, inclusions and Minimum Commitment Periods in Schedule 1, as updated from time to time in accordance with clause 19.
Minimum Commitment Period: the initial minimum membership period specified for the relevant membership category in Schedule 1.
Services: the Facility, memberships, bookings, indoor golf simulation, coaching, club fitting, performance training, digital content and any other products or services offered by Golf 365.
Stored Payment Method: the credit card or other approved payment method nominated by a Member, or by a parent or guardian on behalf of a Member under 18, and updated from time to time in accordance with clause 11.
Terms: these Terms of Use, including the schedules.
2.Application of Terms
2.1These Terms apply to each Member and to each booking and use of the Facility or Services by a Member.
2.2A person must register, accept these Terms and complete any required induction before becoming a Member or receiving autonomous access to the Facility.
2.3A Member must ensure that each Guest and Complimentary Child accompanying the Member complies with these Terms and the Facility Rules in Schedule 3. The Member is responsible for their conduct and for any loss or damage they cause.
2.4Golf 365 may direct a Member, Guest or Complimentary Child to leave the Facility if their conduct is unsafe, disruptive or inconsistent with these Terms or the Facility Rules in Schedule 3. A person so directed is no longer authorised to be at the Facility and must leave without delay.
3.Memberships
3.1The available membership categories, fees and inclusions are set out in the Membership Schedule in Schedule 1.
3.2Memberships are personal and non-transferable.
3.3The Elevate Casual membership continues monthly until cancelled. A Member may cancel it by giving notice by email to hello@golf365.com.au at least 7 days before the next monthly payment date. The membership continues until the end of the month already paid for.
3.4The Elevate Starter, Elevate Premium and Elevate Performance memberships each have a 12-week Minimum Commitment Period. If a Member cancels during that period, the Member remains liable for the fees payable for the balance of that period unless Golf 365 agrees otherwise in writing.
3.5A Member on a membership with a Minimum Commitment Period may suspend the membership for up to 2 weeks during that period, by email or using such other method as may be notified by Golf 365. Fees are paused during the suspension and the Minimum Commitment Period is extended by the same period.
3.6At the end of a Minimum Commitment Period, the membership continues on a rolling weekly basis at the same weekly rate until either Golf 365 or the Member gives at least 7 days notice by email to end it.
3.7If a scheduled payment is not received by the due date, Golf 365 may notify the Member and allow a further 7 days for payment. Golf 365 may suspend access if payment is not made within that period. If payment remains outstanding after a further 7 days, Golf 365 may cancel the membership under clause 17.
3.8Golf 365 may from time to time offer promotional membership pricing or terms, as set out in Schedule 4. Each promotional offer specifies the membership category it varies, the promotional price or terms, and the period for which it is available. Unless a promotional offer expressly states otherwise, all other provisions of these Terms apply to a membership taken up under a promotional offer with such adaptations as are necessary. A promotional price applies for the period stated in the offer and, if no period is stated, for no more than 12 months, after which the Member’s fee reverts to the then-current standard fee for that membership category under the Membership Schedule in Schedule 1. A Member who joins under a promotional offer retains the benefit of that offer for the period stated, regardless of whether the offer subsequently closes or is removed from Schedule 4.
4.Bookings
4.1Bookings are subject to availability and confirmation through the Booking Platform or another process approved by Golf 365.
4.2The booking rights and advance booking windows for each membership category are set out in the Membership Schedule in Schedule 1.
4.3An Elevate Starter Member may book sessions up to the number per week and maximum duration specified in the Membership Schedule in Schedule 1. Unused sessions expire at the end of each week and do not accumulate.
4.4An Elevate Premium or Elevate Performance Member may book a session on any day of the week, but may not use the Facility for more than 1 hour in total on any day.
4.5A Member must be present throughout any booking made for the Member, a Guest or a Complimentary Child.
4.6If a booking is cancelled with less than 12 hours notice, or the Member does not attend:
- for an Elevate Casual Member, the booking and the prepaid amount is forfeited;
- for an Elevate Starter Member, the booking counts as one of the Member’s permitted weekly sessions; and
- for a Member in any other membership category, Golf 365 may charge the late-cancellation or no-show fee in the Fee Schedule in Schedule 2.
4.7If a booking is cancelled with 12 or more hours notice:
- for an Elevate Casual Member, the prepaid bay-hire fee will be credited towards a future booking;
- for an Elevate Starter Member, the booking will not count as one of the Member’s permitted weekly sessions; and
- for a Member in any other membership category, no late-cancellation or no-show fee will be charged.
4.8Golf 365 may reschedule or cancel a booking affected by maintenance, technical issues or a Force Majeure Event. Where reasonable, Golf 365 will offer a replacement booking or credit.
5.Access
5.1Membership includes 24/7 autonomous access, subject to these Terms, the Membership Schedule in Schedule 1, completion of the studio induction and any temporary closure required for safety, maintenance or events beyond Golf 365’s reasonable control.
5.2Autonomous access is provided through the Booking Platform. The access mechanism is activated by the Member in connection with their booking, in the manner notified by Golf 365 from time to time.
5.3Access permissions are personal to the Member and must not be shared, copied, transferred or used to permit unauthorised entry.
5.4Golf 365 may deactivate access immediately if a membership is suspended or cancelled or if access permissions are misused.
6.Guests and Children
6.1A Member in any membership category may bring one Guest to a booking. The Member must prepay the Guest fee in the Fee Schedule in Schedule 2 when making the booking.
6.2A Member may bring up to 2 Complimentary Children to a booking. A Complimentary Child does not count towards the Guest limit.
6.3A Child must be accompanied and actively supervised by the Member at all times while in the Facility, unless participating in an Approved Supervised Program.
6.4A parent or guardian must consent to a Child’s participation and acknowledge the risks described in clause 8 before the Child first uses the Facility or participates in an Approved Supervised Program.
6.5If a Guest who is a Child, or a Complimentary Child, is not the Member’s own child, the Member warrants that the consent required under clause 6.4 has been obtained from that child’s parent or guardian, and that the parent or guardian has been made aware of and acknowledges the risks described in clause 8. The Member indemnifies Golf 365 against any liability, loss, cost or claim arising from that child’s participation in the Facility or Services.
7.Coaching and Performance Services
7.1Golf 365 provides coaching and performance services and does not guarantee any particular outcome. Results depend on individual effort, ability and circumstances outside Golf 365’s control. Each Member and participant is responsible for assessing their own physical condition before undertaking any training, drills or physical activity, and for applying any advice in a manner suited to their individual circumstances.
7.2If not held, the monthly private coaching session included in an Elevate Performance membership expires at the end of each month and does not accumulate.
8.Health, Safety and Recreational Risk
8.1Golf, simulator use, coaching and physical training are recreational activities involving inherent risks. These include injury from swinging clubs, ball strikes or ricochets, slips, trips or falls, equipment malfunction and physical exertion.
8.2By accepting these Terms and using the Facility or Services, a Member acknowledges and voluntarily accepts those risks and participates at the Member’s own risk.
8.3To the maximum extent permitted by law, Golf 365 excludes liability arising from a failure to exercise reasonable care and skill in supplying recreational services for death, physical or mental injury, disease or another harmful condition suffered by a Member in connection with the recreational activities supplied by Golf 365. This exclusion does not apply to liability that cannot lawfully be excluded, including liability for significant personal injury caused by Golf 365’s reckless conduct.
8.4Where a Member brings a Child to the Facility, the Member acknowledges the risks in this clause on that Child’s behalf. Where the Member is the Child’s parent or guardian, that acknowledgment is given in that capacity. Where the Member is not the Child’s parent or guardian, clause 6.5 applies.
9.Damage
9.1A Member is responsible for loss or damage caused by the Member, a Guest or a Complimentary Child to the Facility, including simulator technology, screens, impact surfaces, clubs, launch monitors, equipment, fixtures, furniture and premises.
9.2Golf 365 may recover the reasonable cost of repair or replacement and downtime costs calculated at the Facility Downtime Rate for the reasonable period during which any simulator bay is unavailable as a direct result of the loss or damage. If Golf 365 makes an insurance claim, the insurer’s recovery rights are preserved and the Member’s liability is not limited to any insurance excess paid by Golf 365.
9.3Golf 365 may debit a Stored Payment Method for repair, replacement or downtime costs only after notifying the Member of the amount and the basis for the charge and allowing the Member a reasonable opportunity to query it.
10.Facility Rules and Conduct
10.1A Member must comply, and must ensure that each Guest and Complimentary Child complies, with the Facility Rules in Schedule 3 and any reasonable instruction or signage at the Facility.
10.2Golf 365 may take action under clause 17 in response to unsafe conduct, misuse of equipment, property damage, unauthorised commercial instruction or coaching, misuse of access permissions or other serious or repeated breaches.
11.Fees, Payments and Stored Payment Method
11.1All prices are in Australian dollars and are inclusive of GST where GST applies. Fees and charges are set out in the Membership Schedule in Schedule 1 and Fee Schedule in Schedule 2.
11.2Payments may be processed through approved third-party payment providers.
11.3A Member must maintain a valid Stored Payment Method while the membership is active and promptly update it if it expires, is cancelled or becomes invalid. Golf 365 may suspend access while a valid Stored Payment Method is not maintained.
11.4Golf 365 may debit the Stored Payment Method for the charges listed in the Fee Schedule in Schedule 2 when the relevant charge becomes payable under these Terms or is otherwise agreed by the Member.
11.5The authority continues until both: (a) the membership has ended; and (b) all outstanding amounts have been paid. If a Stored Payment Method is provided by a parent or guardian on behalf of a Member under 18, the authority applies to charges attributable to that membership.
12.Refunds
12.1Membership fees, bookings and coaching fees are not refundable, except as set out in clause 12.2. No refund is given for a change of mind. A missed or forfeited booking is not credited.
12.2If Golf 365 cancels a membership or Service for a reason other than the Member’s breach, Golf 365 will refund the fees paid for the unused part of that membership or Service. The refund is reduced by the value of any replacement booking or credit already given to, and accepted by, the Member for that unused part.
12.3Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified.
13.Technical Issues
13.1Golf 365 does not guarantee continuous availability of simulators, software, the Booking Platform, access systems, the website or other Services.
13.2Golf 365 is not liable for interruptions caused by equipment faults, software outages, power or internet failures, maintenance or Force Majeure Events.
13.3Where reasonable, Golf 365 may offer rescheduling or a credit.
14.Intellectual Property
14.1Unless otherwise stated, Golf 365 owns or is licensed to use all content made available through its website and Services, including training systems, coaching programs, videos, educational materials, branding, logos, graphics, written content and performance systems.
14.2A Member must not copy, reproduce, distribute or use that content for a commercial purpose without Golf 365’s prior written consent.
15.Personal Information and CCTV
15.1CCTV may be used at the Facility for safety, security and operational purposes.
15.2Golf 365 may collect personal information through membership applications, bookings, payment arrangements, access systems, CCTV, Trackman systems, coaching and communications with Members.
15.3Golf 365 will collect, use and disclose personal information only as reasonably necessary to operate and manage the studio, administer memberships, bookings, payments and access, provide the Services, support safety and security, communicate with Members, comply with law and protect Golf 365’s lawful interests.
15.4Golf 365 may disclose personal information to service providers operating systems used for those purposes, including booking, payment, access-control and Trackman systems. Golf 365 will not sell personal information or use it for an unrelated purpose without consent unless required by law.
15.5Golf 365 does not seek to collect medical, injury or fitness-related health information unless reasonably necessary for a practical purpose. If Golf 365 collects, holds or uses health information, it will handle that information in accordance with applicable privacy laws.
16.Third-Party Services
16.1The website or Services may link to or integrate third-party providers, software, payment processors, booking systems or access-control systems.
16.2Third-party services are subject to the provider’s own terms. Golf 365 is not responsible for a third-party platform or its content.
16.3The Booking Platform is operated by Trackman, a third-party provider, under Trackman’s own terms of use and privacy notice. A Member who creates a Trackman account agrees to Trackman’s terms separately. These Terms govern the Golf 365 membership only.
17.Suspension and Termination
17.1Golf 365 may suspend access immediately if there is a safety breach, property damage, misuse of equipment, unauthorised commercial instruction or coaching, misuse of access permissions, failure to maintain a valid Stored Payment Method or other serious or repeated breaches.
17.2For a payment default, Golf 365 will give the notice specified in clause 3.7 before cancelling the membership.
17.3For another breach capable of remedy, Golf 365 may give written notice and a reasonable opportunity to remedy the breach before cancelling the membership.
17.4Suspension or termination does not affect liability for outstanding fees, damage or another accrued obligation.
17.5If Golf 365 cancels a membership other than for a breach by the Member, clause 12.2 applies.
18.Limitation of Liability
18.1To the maximum extent permitted by law, Golf 365 is not liable for indirect, incidental, consequential or special loss arising from the Services or use of the Facility.
19.Changes to Terms and Schedules
19.1Golf 365 may update these Terms, including the schedules, by publishing an updated consolidated version on its website. The website version is the authoritative current version from its stated effective date.
19.2Updates will take effect as follows:
- An administrative, operational or beneficial change may take effect on publication or on a later date stated by Golf 365.
- An increase in fees or material reduction in membership inclusions during a Minimum Commitment Period requires the Member’s express written consent before it applies to that Member during the Minimum Commitment Period.
- Otherwise, Golf 365 will give Members at least 21 days notice before a material change takes effect.
19.3If a Member does not accept a material change, the Member may end the membership by giving notice before the change takes effect. No early-cancellation amount is payable if the Member ends a membership under this clause.
19.4Continued use of the Services after a revised version takes effect constitutes acceptance of the revised Terms.
20.Governing Law
20.1These Terms are governed by the laws of New South Wales.
20.2The courts of New South Wales have jurisdiction in relation to any dispute arising in connection with these Terms.

Notes: A Complimentary Child does not count towards the Guest limit. A Member must remain present throughout any booking involving a Guest or Complimentary Child. Unused Elevate Performance coaching sessions expire and do not accumulate.

S3Schedule 3 — Facility Rules
- The studio induction must be completed before using autonomous access.
- Use the Facility only during a confirmed booking and leave promptly when the booking ends.
- Do not share an access link, application permission, code or other access credential.
- Use golf clubs, balls, simulator technology and other equipment safely and only as intended.
- Check that the bay is clear before swinging a club or striking a ball.
- Use only clean, appropriate golf clubs, balls and footwear.
- Do not bring food or drinks into a simulator bay or place them near equipment.
- Do not enter or use the Facility while affected by alcohol or drugs.
- Do not engage in unsafe, abusive, disruptive or unlawful conduct.
- Do not damage, interfere with or attempt to repair equipment.
- Do not provide commercial golf instruction or coaching at the Facility unless authorised by Golf 365.
- Keep the Facility clean, secure and undamaged.
- A Member may bring no more than one Guest and 2 Complimentary Children to a booking.
- A Member must remain present and actively supervise each Guest and Complimentary Child throughout the booking.
- Follow all signage, emergency procedures and reasonable instructions given by Golf 365.
- Report any injury, safety issue, equipment fault or damage to Golf 365 promptly.
- In an emergency, call 000 and leave the Facility if it is unsafe to remain inside.
S4Schedule 4 — Promotional Offers
This schedule sets out current promotional offers available under clause 3.8. Each offer varies the membership category specified below only to the extent stated. All other provisions of the Terms of Use apply.
